User Agreement on the Use of Services gastrobaiter.com
This User Agreement regulates the relationship between the website "International Labor Exchange for Migrant Workers" (hereinafter referred to as the "Website Administration") and the Internet user ("User") arising from the use of the Internet resource www.gastrobaiter.com ("Website"), on the terms specified in the User Agreement.
Full and unconditional acceptance of this offer to the User to conclude an agreement is the User's actions aimed at using, registering on the website as a participant, sending messages via the contact form and other actions to use the functionality of the Website.
The User Agreement may be changed by the Website Administration at any time without any special notice to the User. The new version of the User Agreement comes into force from the moment it is posted on the Website, unless otherwise expressly stated. Regular familiarization with the current version of the User Agreement is the responsibility of the User. Using the Site after the new version of the User Agreement comes into force means the User's consent to it and the full application of the provisions of the new version to him. If the User does not agree with its terms, the User should immediately stop using the Site and send a written request to the Site Administration to delete his personal data from the Site database.
1. Terms and definitions
For the purposes of this User Agreement, the following terms have the following meanings:
Site - an Internet resource located on the Internet at https://gastrobaiter.com. Depending on the context, the Site also means the Site software, the design (graphic design) of the Site, the Database, any section (subsection) of the Site, as well as the Information posted on the Site by the Site Administration and Users.
Site Administration - OOO Nord West Stroy, St. Petersburg, which owns all relevant exclusive property rights to the Site, including the rights to the domain name of the Site, and administers it.
User - any person accessing the Site, thereby automatically confirming that he/she fully agrees with the provisions of this User Agreement, and that the requirements established by this User Agreement apply to him/her.
User's personal information - any information that the User provides about himself/herself independently upon registration or in the process of using the Site, including the User's personal data, information that is automatically transferred to the Site Administration in the process of using the Site using the software installed on the User's device, including the IP address, cookie information, information about the user's browser, as well as other data about the User.
Employer - an individual or legal entity that employs a foreign citizen.
Services - functional capabilities, services, services, tools available to Users.
Registration - a set of actions by the User in accordance with the instructions specified on the Site, including the provision of Account Data and other information performed by the User using a special form of the Site's user interface in order to create a Personal Account and gain access to individual Services of the Site.
Information — any materials and information provided by the User in connection with the use of the Site.
2. Subject and General Provisions of the User Agreement
2.1. This User Agreement sets forth the rules and conditions for using the Site and posting information on it and constitutes an agreement between the User and the Site Administration.
2.2. The Site Administration offers the User, under the terms of this User Agreement, to use the Services for the adaptation of labor migrants (quizzes, consulting webinars and seminars, forum) and other Services offered on the Site. Additional conditions, rules and restrictions may be established with respect to the use of individual Services.
The Site Administration has the right to revise or change the terms of provision of Services, supplement, change, limit, expand the functionality of the Site and/or Services, including the conditions for the User's access to the Services or individual functionality of the Site, at any time.
2.2. The Services are provided to the User both on a paid and free of charge basis, in accordance with the conditions specified in this User Agreement.
2.3. The provision of individual Services may be regulated by special rules and/or agreements that are an integral part of this User Agreement, including the terms of posting vacancies by Employees (Job Seekers) and Employers, other terms and rules, individual agreements drawn up in writing and signed by the Site Administration and the User. In the event of a contradiction or inconsistency between the text of this User Agreement and special rules and/or agreements, the latter shall apply.
2.4. The Site is a platform that allows you to independently publish your questions on migration legislation, as well as about your life situations and address them to the Site Administration or an indefinite number of persons from among the Site visitors (lawyers, employers and foreign citizens).
2.5. Regardless of the fact of Registration or authorization of the User on the Site, use of the Site, including viewing the information posted on the Site, means the User's consent to this User Agreement and the acceptance of obligations to follow the instructions for using the Services, as well as responsibility for actions related to the use of the Site.
2.6. By accessing the Site and thus concluding this User Agreement, the User guarantees that he/she has all the rights and powers necessary to conclude and execute the User Agreement, including being an adult and fully capable person, or a minor declared fully capable by a decision of an authorized body (emancipation) or a minor who has reached the age of fourteen and received written permission in the form required by law from his/her parents or other legal representatives to conclude the User Agreement. The Site Administration has the right at any time to require the User to provide information and documents confirming the rights and powers, as specified above.
2.7. The Services provided on the Site may be changed, supplemented, updated, change the form and nature of the functional capabilities at any time without prior notice to the User, in connection with which their use is offered in the "as is" mode, i.e. in the form and volume in which they are provided by the Site at the time of access to the Services by Users.
The Site Administration has the right, if necessary, at its own discretion, to terminate (temporarily or permanently) the provision of Services (or any individual functions within the Services) to all Users as a whole or to an individual User, in particular, without prior notice.
3. Registration on the Site
3.1. The User has the right to register on the Site as a participant and also use individual Services after Registration on the Site.
3.2. When Registering, the User specifies the login details (last name and first name, email address, phone number, citizenship, organization name and password for registration). After entering the data for Registration, the User receives a message to the specified email address confirming his registration as a participant and providing a special link to the page for entering the virtual room of the webinar participant.
In order to publish questions on migration legislation, it is necessary to create an announcement indicating the title, description of the vacancy in free form on the page of the "Forum for labor migrants". All announcements are moderated after publication. In case of detection of violations of the rules of placement, the announcement-question will be removed from publication.
4. User's Personal Information
4.1. When processing the User's Personal Information, the Site Administration undertakes to take all organizational and technical measures to protect the User's Personal Information from unauthorized or accidental access, destruction, modification, blocking, copying, distribution, as well as from other illegal actions by third parties. However, it is possible that as a result of a failure in the Site's operation, a virus or hacker attack, technical malfunctions and other circumstances, the User's Personal Information may become available to other persons. The User understands this and agrees that he/she will not make claims against the Site Administration in connection with this.
4.2. The User agrees that the Site Administration collects, stores and performs other actions to process the User's Personal Information for the following purposes:
Providing the User with personalized services;
Communication with the User, including sending notifications, requests and information regarding the use of the Site, provision of services, as well as processing requests and applications from the User;
Improving the quality of the Site, ease of use, developing new services and services;
Conducting statistical and other studies based on anonymized data;
Information mailing via e-mail about changes in migration legislation and information about new site functionality;
Compiling a database of Site users.
4.3. By posting their Personal Information on the Site, the User confirms that they do so voluntarily, and that they voluntarily provide this Information to the Site Administration.
4.4. The User undertakes not to post personal information of other persons on the Site, as well as not to use personal information of other Users that in any way does not comply with the requirements of the legislation of the Russian Federation, for illegal or unlawful purposes, for the purpose of extracting benefits and for any other purposes that do not correspond to the purposes of creating the Site.
4.5. The User may at any time change (update, supplement) the Personal information provided by him or her or part of it.
4.6. The User's Personal information is processed by the Site Administration during the period of its posting on the Site or the period established by the current legislation.
4.7. Without prejudice to other provisions of the Agreement, the Site Administration has the right to transfer the User's Personal information to third parties in the following cases:
The User has expressed their consent to such actions;
The transfer is necessary within the framework of the User's use of the Site or for the provision of services to the User;
Such transfer is provided for by Russian or other applicable legislation within the framework of the procedure established by law;
Such transfer occurs within the framework of the sale or other transfer of a business (in whole or in part), while all obligations to comply with the terms of this Agreement in relation to the User's Personal Information received by it are transferred to the acquirer;
In order to ensure the possibility of protecting the rights and legitimate interests of the Site Administration or third parties in cases where the user violates the terms of this Agreement;
4.8. When processing the User's personal data, the Site Administration is guided by the Federal Law of the Russian Federation "On Personal Data".
5. User Obligations
5.1. The User undertakes to act exclusively in accordance with the current legislation and the User Agreement of the Site, and to bear full responsibility for their own actions and inactions on the Site and when using the Services in accordance with the legislation of the Russian Federation.
5.2. The Site Services available to the User may be used solely for the purposes for which such Services are intended. The User is prohibited from using the services, as well as any information received on the Site, for other purposes.
5.3. By registering on the Site, the User expresses their consent to receive advertising information posted on the Site by third parties. The User understands and agrees that the Site Administration does not determine the content and is not responsible for such information, including sites, links to which may be contained in the relevant materials.
5.4. The User of the Site undertakes not to use any data provided by another User without the written permission of the person who posted such information, or without confirmation in any other way of the right to use such information. All information received by the User about other Users in connection with the use of the Site may only be used to conclude and fulfill employment agreements. Thus, the User is prohibited from using the e-mail address and/or telephone number of another User for the purposes of direct advertising or other distribution of unsolicited electronic messages, as well as for other illegal actions or actions committed without the knowledge and/or consent of the other party. In order to facilitate interaction between Users, the services imply limited access to some contact information of other Users. The right to use Information provided by other Users is limited by this User Agreement.
6. Exchange of information when using the Site
6.1. Messages from the Site Administration intended for Users are published for general access on the Site and/or sent individually to the email addresses provided by Users during Registration. The User understands, accepts and agrees that the messages sent and/or their individual parts may be of an advertising nature and may also contain advertising, informational and other messages from the Site Administration's counterparties. Messages published on the Site are considered delivered to the User from the moment of their publication.
6.2. By accessing the Site, the User expresses his/her consent that the Site Administration may send the User messages, including electronic letters (e-mail) to the e-mail address specified by him/her on the Site, respectively, such as, but not limited to: messages from Users regarding vacancies and/or candidates, including proposals to conclude agreements from other Users, proposals and messages of other informational and/or advertising nature from the Site Administration or companies - partners of the Site Administration, as well as transfer e-mail addresses and telephone numbers to third parties for the purpose of sending the said messages.
7. Functioning of the Site and liability for its use
7.1. The Site Administration tries to ensure the proper functioning of the Site around the clock, however, the Site Administration does not bear any responsibility if any disruptions in the Site occur for any reason.
7.2. The Site Administration does not guarantee that the Information posted on the Site will be available at any time, or will not be deleted or lost. The Site Administration is not responsible for failures and delays in the Site, as well as for the possible consequences of such failures and delays.
7.3. The Site Administration is not responsible for a possible leak of Information from the Site Database for any reason, including as a result of unauthorized actions of third parties.
7.4. The Site Administration shall not be liable, shall not compensate or bear responsibility for any damages, including lost profits, moral or other harm caused to the User or third parties as a result of their use of the Site or in connection with the functioning of the Site, as well as in all other cases provided for in this Agreement.
7.5. The User shall bear full responsibility for the information posted by him/her on the Site and/or communicated by him/her to other Users or third parties via the Site, including for its content and compliance with the requirements of the legislation of the Russian Federation, for the violation of the rights of third parties to the Information posted and/or communicated by the User (including, but not limited to, the rights of the author and/or related rights, the rights to means of individualization, the rights to commercial secrets and other rights protected by law). The User shall independently compensate for any losses (including lost profits, moral and other damages) incurred by other Users, third parties or the Site Administration as a result of the said violations and/or posting of such Information on the Site, and/or communication of such Information via the Site, as well as the performance of other actions in connection with the use of the Site.
7.6. The User undertakes to resolve all disputes and settle all claims and actions of third parties, orders and demands of authorized state authorities received both by the User and by the Site Administration in connection with the User posting Information on the Site, and also to compensate for all losses and expenses incurred by the Site Administration in connection with such claims and actions.
8. Validity of the User Agreement
8.1. This User Agreement shall enter into force from the moment the User uses the Site, regardless of the fact of User Registration, and shall be valid indefinitely.
8.2. The User has the right to terminate access to his/her Personal Account without the possibility of restoring such access. In this case, the User has no right to re-Register, including using the email address previously specified by the User on the Site as part of the Account Data.
